Booking Terms & Conditions

These Terms of Service ("Terms") govern your use of the Protour Africa website www.protour.africa and your participation in any journey, experience, or service offered by Protour Africa LTD, a company registered in Ghana (collectively, "Protour Africa," "we," "us," or "our").
By accessing our website or booking a journey with us, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Our Services
Protour Africa provides heritage reconnection journeys, cultural immersion experiences, and related travel services primarily in Ghana and Africa. Our services include journey planning and coordination, ground transportation within the destination country, accommodations, meals, heritage site visits, cultural experiences, naming ceremonies, cultural custodian guidance, pre-trip preparation materials, and post-trip support.
We are a travel experience provider, not a travel agent. We design, operate, and lead our own journeys. We are not acting as an agent for any airline, hotel, transportation provider, or other third party unless explicitly stated.
2. Eligibility
Our journeys are open to adults aged 18 and over. Travellers under 18 may participate when accompanied by a parent or legal guardian who accepts these Terms on their behalf and assumes full responsibility for the minor.
By booking a journey, you confirm that you are legally capable of entering into a binding agreement and that all information you provide is accurate and complete.
3. Booking and Payment
3.1 How to Book
Bookings are made through our booking platform, currently WeTravel. When you book through WeTravel, you are also subject to WeTravel's terms of service and privacy policy, which are available on their website.
A booking is confirmed when we have received your deposit payment and sent you a written booking confirmation via email or chat.
3.2 Pricing
All prices are listed in US Dollars (USD) unless otherwise stated. Prices include the items specified in the "What Is Included" section of the relevant journey description on our website. Items not listed as included are at your own expense.
We reserve the right to adjust pricing for future journeys. Once your booking is confirmed, the price of your journey will not change unless there are extraordinary circumstances beyond our control (see Section 9, Force Majeure).
3.3 Payment Schedule
Deposit: A non-refundable deposit of 20% is required at the time of booking to secure your place.
Balance: The remaining balance is due no later than 14 days before the journey departure date. If the balance is not received by this date, we reserve the right to cancel your booking and retain the deposit.
Payment Plans: We offer flexible payment plans through our booking platform. Details are provided during the booking process.
3.4 Payment Processing
Payments are processed by WeTravel and their payment processors (Stripe and/or Airwallex). Protour Africa does not directly handle or store your credit card or bank account information. Payment disputes related to processing should be directed to WeTravel or the relevant payment processor.
4. Cancellation and Refunds
4.1 Standard Cancellation Terms
The following standard cancellation terms apply unless a journey-specific cancellation policy is provided at the time of booking:
More than 90 days before departure: Full refund minus the non-refundable deposit.
60-89 days before departure: 20% refund of the total journey cost (deposit not refundable).
30-59 days before departure: 30% refund of the total journey cost.
15-29 days before departure: 50% refund of the total journey cost.
Less than 15 days before departure: No refund.
All cancellation requests must be submitted in writing to admin@protour.africa.
4.2 Journey-Specific Cancellation Policies
Certain journeys may have cancellation terms that differ from the standard policy above. This may apply due to the nature of the journey, the destination, supplier requirements, special event or festival timing, group size commitments, or other factors specific to that experience.
Where a journey-specific cancellation policy applies, it will be clearly communicated to you in writing before you complete your booking. The journey-specific policy will be included in your booking confirmation and will form part of these Terms.
In the event of any conflict between the standard cancellation terms and a journey-specific cancellation policy, the journey-specific policy shall take precedence for that booking.
4.4 Cancellation by Us
We reserve the right to cancel a journey if the minimum number of participants is not met, due to safety concerns, political instability, natural disasters, or other circumstances beyond our control, or if continuing the journey would compromise the quality or safety of the experience.
If we cancel a journey, you will receive a full refund of all amounts paid, including your deposit, or the option to transfer your booking to a future departure date. We are not liable for any additional costs you may have incurred, such as flights, travel insurance, or visa fees.
4.5 Changes and Transfers
Date Transfer: If you cannot travel on your booked date, you may request a transfer to a future departure date, subject to availability. Transfer requests made more than 15 days before departure are accommodated at no additional charge. Requests made within 15 days of departure may incur a transfer fee, subject to the nature of the journey package.
Name Transfer: You may transfer your booking to another person, subject to our approval, provided the replacement traveller meets all journey requirements. Name transfers must be requested in writing at least 15 days before departure.
4.6 Travel Insurance
Travel insurance is mandatory for all participants. Your travel insurance policy should cover, at minimum, trip cancellation, trip interruption, medical emergencies, emergency evacuation, and personal liability. We strongly recommend purchasing travel insurance at the time of booking, as many policies offer better coverage when purchased within a specific window of the booking date.
We are not responsible for any costs or losses that would have been covered by adequate travel insurance.
5. Your Responsibilities
5.1 Travel Documents
You are responsible for ensuring that you hold a valid passport with at least six months' validity beyond your return date, the required visa for entry into Ghana (and any other countries included in your journey), all required vaccinations (including Yellow Fever, which is mandatory for Ghana), and any other travel documents required by your country of origin or destination.
We provide guidance on visa and vaccination requirements in our pre-trip preparation materials, but it is your responsibility to verify current requirements with the relevant embassy, consulate, or health authority. We are not liable for any costs or consequences arising from inadequate travel documents.
5.2 Health and Fitness
You must inform us of any medical conditions, allergies, dietary requirements, mobility limitations, or other health considerations that may affect your participation at the time of booking or as soon as they arise. We will make reasonable efforts to accommodate your needs, but we cannot guarantee that all accommodations can be made.
You confirm that you are physically and mentally fit to participate in the journey as described. If we reasonably determine that your health or fitness poses a risk to yourself or other participants, we reserve the right to decline or limit your participation without refund.
5.3 Conduct
You agree to follow the instructions and guidance of our team, cultural custodians, and local partners throughout the journey. You agree to treat all heritage sites, cultural spaces, and community environments with respect and reverence. You agree to conduct yourself in a manner that does not endanger, disrupt, or diminish the experience of other travellers. You agree to respect photography guidelines, including camera-free moments at heritage sites. You agree to comply with the laws of Ghana and any other countries visited during the journey.
We reserve the right to remove any participant from a journey if their conduct is disruptive, disrespectful, or endangers the safety of others. In such cases, no refund will be provided and any additional costs (including return travel) are your responsibility.
6. Our Responsibilities and Limitations of Liability
6.1 Our Commitment
We are committed to delivering a high-quality, emotionally meaningful, and safe heritage reconnection experience. We exercise reasonable care in selecting accommodations, transportation providers, cultural custodians, and local partners. We provide experienced guidance throughout the journey. We prepare you in advance and support you afterward.
6.2 Limitation of Liability
To the maximum extent permitted by law, Protour Africa, its founders, employees, agents, and partners shall not be liable for:
Third-Party Actions: Loss, injury, damage, or expense arising from the acts, omissions, or negligence of third parties, including airlines, hotels, ground transportation providers, or other service providers not directly employed by Protour Africa.
Force Majeure: Loss, injury, damage, or expense arising from events beyond our reasonable control (see Section 9).
Personal Decisions: Loss or expense arising from your failure to obtain adequate travel documents, vaccinations, travel insurance, or to disclose relevant health information.
Emotional Distress: Heritage reconnection journeys involve visits to sites of historical trauma and participation in emotionally significant rituals. While we provide preparation and support, the emotional impact of these experiences is inherently personal and unpredictable. We cannot be held liable for emotional distress, psychological impact, or related consequences arising from your participation in the journey.
Indirect or Consequential Losses: Lost profits, lost enjoyment, or other indirect or consequential damages arising from your participation or inability to participate.
6.3 Maximum Liability
In the event that we are found liable for any claim arising from your journey, our total liability shall not exceed the total amount you paid to Protour Africa for the specific journey in question.
6.4 No Guarantee of Specific Outcomes
Heritage reconnection is a deeply personal experience. While we design every journey to create the conditions for meaningful transformation, we cannot guarantee specific emotional, spiritual, or personal outcomes. Each traveller's experience is unique.
7. Assumption of Risk
Travel to Ghana and West Africa involves inherent risks, including but not limited to risks associated with international air travel, ground transportation in developing infrastructure, tropical climate and weather conditions, exposure to unfamiliar foods and environments, health risks including tropical diseases, and visiting heritage sites that may have uneven surfaces, narrow passages, or limited accessibility.
By booking a journey with us, you acknowledge and accept these risks. You confirm that you have made your decision to participate voluntarily and with full awareness of the inherent risks involved.
Heritage-specific risks include exposure to emotionally challenging content related to slavery, the slave trade, and historical trauma at heritage sites. We provide preparation and support, but you acknowledge that the emotional impact of these experiences is inherent to the nature of the journey and cannot be fully anticipated or controlled.
8. Intellectual Property
8.1 Our Content
All content on the Protour Africa website, including text, photographs, graphics, logos, icons, design elements, and brand materials, is the property of Protour Africa or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or use our content without our written permission.
8.2 Your Content
If you provide us with photographs, testimonials, reviews, or other content related to your journey, you grant Protour Africa a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for marketing and promotional purposes, subject to the consent and attribution terms described in our Privacy Policy (Section 14). You may withdraw this licence at any time by contacting us in writing.
9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, severe weather, epidemics or pandemics, government actions or restrictions, political instability or civil unrest, war or threat of war, terrorism, strikes or labour disputes, transportation disruptions (airline cancellations, route changes), or infrastructure failures.
In the event of force majeure, we will make reasonable efforts to offer alternative arrangements, a rescheduled journey, or a credit toward a future booking. Refunds in force majeure situations will be determined on a case-by-case basis, taking into account costs already incurred by Protour Africa on your behalf.
10. Itinerary Changes
We reserve the right to make changes to the published itinerary before or during the journey if necessary due to safety concerns, weather conditions, site closures, local regulations, or logistical requirements. We will make reasonable efforts to notify you of significant changes in advance and to provide comparable alternatives.
Minor variations to the itinerary (such as the order of activities within a day, meal locations, or timing adjustments) are a normal part of travel and do not constitute a material change.
11. Disputes and Governing Law
11.1 Informal Resolution
If you have a complaint or dispute regarding your journey, we encourage you to contact us directly at [INSERT EMAIL] so we can attempt to resolve the matter informally. Most issues can be addressed quickly through open communication.
11.2 Governing Law
These Terms are governed by the laws of the Republic of Ghana, without regard to its conflict of law provisions.
11.3 Jurisdiction
Any legal proceedings arising from these Terms or your participation in a Protour Africa journey shall be brought in the courts of Ghana. You consent to the jurisdiction of these courts.
12. Indemnification
You agree to indemnify and hold harmless Protour Africa, its founders, employees, agents, cultural custodians, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law or regulation, your negligent or wrongful conduct during a journey, or any dispute between you and a third party arising from your participation in a journey.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
14. Entire Agreement
These Terms, together with our Privacy Policy, booking confirmation, and any journey-specific terms provided at the time of booking, constitute the entire agreement between you and Protour Africa regarding your use of our website and participation in our journeys. They supersede any prior agreements, communications, or representations, whether oral or written.
